US Senate Passes Hours of Service Language
The US Senate recently passed the Surface Transportation Bill, which includes language clarifying the Hours of Service exception for agricultural supplies. The language re-asserts that the HOS exception applies to deliveries of farm supplies within a 100 mile radius of the wholesale or retail distribution point. Several years ago, FMCSA had issued an interpretation that HOS does not apply to transportation of supplies from a wholesale location, such as a terminal. Our industry has since been operating under a 2 year waiver for delivery of anhydrous ammonia only from wholesale/terminal distribution points. That waiver expires in the fall of 2012. The US House will take up the Senate bill when they return from Easter Break April 17, and our national groups TFI and ARA are working very hard to assure the HOS language is contained in the final transportation bill sent to the President.
