It's That Time of Year

Despite legislation a few years ago that made 80,000 lbs the default weight limit formula for Illinois roads, state and local jurisdictions still retain the ability to permanently or temporarily post roads below this limit.  And of course this is occurring during the harvest season.  There is a provision in the Illinois Vehicle Code (5/15-111) that provides a 5 mile access from any Class I, II or III designated highway for loading, unloading, food, fuel, repairs or rest.  However, the key phrase in this provision is "designated" highway.  If the local jurisdiction does not designate that road as a truck route, then this 5 mile loading or unloading allowance in the Vehicle Code does not apply.  As with most things in life, it boils down to relationships.  Do you have a good relationship with your local road and township commissioners?  That is usually the best avenue to avoid conflicts with road postings since our state laws provide so much flexibility in this area.
