A Big Win for Agriculture at the U.S. Supreme Court

Illinois Fertilizer and Chemical Association (IFCA) applauds the U.S. Supreme Court for their landmark decision in Sackett v. EPA, which stated that the wetland under the jurisdiction of the Clean Water Act (CWA) must have a 'continuous surface connection with that water,' making it difficult to determine where the water ends and the wetland begins. The ruling was unanimous.
 
IFCA acknowledges the positive impact this ruling has on agriculture, our members, our farmers customers, and rural America.  Our farmer customers can focus on their agricultural operations without fear of unreasonable regulations impeding their progress.  All of agriculture has been waiting for this ruling on defining Waters of the United States (WOTUS).  The decision finally restores common sense back into WOTUS regulation. Hopefully, it lays to rest efforts by EPA and the Army Corps of Engineers to extend CWA jurisdiction well beyond Congressional intent.
 
The Court’s ruling is necessary for both ag retailers and our farmer customers. The EPA needs to expeditiously update the WOTUS regulation according to the clear ruling issued by the Supreme Court.
