Goehring N.D. Prepared to Sue OSHA to Stop Policy Affecting Anhydrous Ammonia Retailers

North Dakota is prepared to take legal action to block a change in federal policy that would force more than 280 retailers of anhydrous ammonia to comply with the same regulations as manufacturers and wholesale distributors of the fertilizer, state Agriculture Commissioner Doug Goehring said Thursday.
 
The policy change by the U.S. Occupational Safety and Health Administration will place 283 facilities in a different regulatory class and could push one-third of them out of the anhydrous ammonia business, Goehring said, citing industry estimates.
 
Farmers would then have to travel farther to pick up the fertilizer, raising their costs and the chances of a mishap.
