Supreme Court Considers Legality of Trump Tariffs
Late last week, the U.S. Supreme Court heard oral argument in the consolidated cases of Learning Resources, vs Donald J. Trump. At issue is whether the International Emergency Economic Powers Act (IEEPA) grants the President authority to impose broad tariffs without congressional approval. President Trump invoked the law to justify tariffs on nearly all imports, citing national emergencies like trade deficits and fentanyl trafficking.
As reported by several news sources, justices expressed skepticism about the administration’s claim that the tariffs were “regulatory” rather than revenue-generating. Critics argue the tariffs function as taxes, a power constitutionally reserved for Congress.
